2. The Prime Minister’s reply: polite, warm, and structurally evasive

The Office of the Prime Minister responded to my letter.
The tone was courteous.
The formatting was immaculate.
The language was reassuring.

But the substance was unmistakable:

• My concerns were “noted.”

• No engagement with the issue occurred.

• No acknowledgement of the WorkSafe gap was made.

• The matter was deflected sideways to Transport, a portfolio unrelated to chemical safety or policing ethics.

This was not escalation.
It was containment — a procedural manoeuvre designed to move the burning fuse into a bucket of sand before it reached anything explosive.

New Zealanders should find this concerning.
It was the second point in the pattern.

3. The Police Morals OIA: the explosion at the end of the fuse

Then came the Police response to my Official Information Act request on moral principles.

This is where the fuse reached the powder.

Police formally confirmed — in writing — that:

A. They have no recorded moral principles anywhere.

Not in the Code of Conduct.
Not in Police Values.
Not in SELF Check.
Not in ethics training.
Not in internal guidance.
Not in any document.

“Police confirms that it does not hold any formally recorded set of moral principles…”

B. Their earlier reference to “moral principles” was just a dictionary definition.

They used the phrase without actually having any.

C. They cannot identify a single moral principle in any part of their system.

They explicitly stated they do not hold any document that:

• records moral principles

• identifies where moral principles appear

• categorises anything as a moral principle

• explains why any content is a moral principle

This is highly unusual for a national policing organisation.

D. The implications are enormous — especially in court.

If an officer’s conduct is challenged:

“What moral principle justified this action?”

The official answer is:

None exist.

This undermines:

• ethical consistency

• public trust

• judicial accountability

• internal integrity

• external oversight

It is not a small administrative oversight.
It is a foundational governance gap.

4. The pattern is now visible

Across three agencies, the same architecture appears:

1. WorkSafe

Not engaged in legislation involving chemical exposure.

2. Prime Minister’s Office

Deflects accountability to an unrelated portfolio.

3. Police

Operate without any defined moral principles.

This is not coincidence.
It is not isolated.
It is not accidental.

It is systemic procedural insulation — a governance culture that avoids moral definition, avoids accountability, and avoids scrutiny.

• When agencies cannot articulate the principles guiding their actions

New Zealanders deserve transparency.
They deserve clarity.
They deserve institutions that can explain — and justify — the moral basis of their decisions.

TODAY I received a courteous, well‑structured email from the Office of the Prime Minister, Rt Hon Christopher Luxon. It was sent in response to my Roadside Drug Test Open Letter, where I raised a fundamental concern: WorkSafe was never engaged in the development or rollout of the roadside drug‑testing legislation. They were not consulted, not involved, and not asked to assess chemical‑exposure risks. They were merely observers.

For a national testing regime involving chemical reagents, public contact, and frontline police exposure, this omission should alarm New Zealanders. It signals a governance gap that cannot be brushed aside.

Luxon’s office thanked me for writing, assured me my concerns had been “noted,” and explained that the Prime Minister relies on his colleagues to respond on his behalf to matters within their portfolios. My correspondence was therefore forwarded to Hon Chris Bishop, Minister of Transport.

On the surface, this is polite and procedural.
But beneath that surface sits a more troubling pattern — one that New Zealanders should recognise as another instance of the Prime Minister deflecting accountability on a matter of public safety.

2. The portfolio shift: a procedural manoeuvre, not a match

My letter did not concern roads, rail, ferries, or transport infrastructure. It concerned governance failures, oversight gaps, and the absence of WorkSafe involvement in legislation that directly affects police officers and the public.

Routing it to Transport is not a substantive match. It is a procedural de‑escalation — a way to move the correspondence sideways rather than upward.

This is not unusual in Wellington, but the choice of portfolio matters. When an issue touches:

• workplace safety

• chemical exposure

• policing practice

• national oversight

• ministerial responsibility

the PM’s office has two options:

1. Engage directly, acknowledging the seriousness of the issue.

2. Deflect, routing it to a low‑risk portfolio that will not generate political exposure.

This reply chose option two.

3. “Your concerns have been noted”: the Beehive’s most famous non‑commitment

The phrase “your concerns have been noted” is one of the most widely used non‑answers in New Zealand government correspondence.

It means:

• The email has been logged.

• The substance will not be addressed.

• No commitment is being made.

• No acknowledgement of the core issue is being offered.

• No escalation will occur.

It is polite, warm, and empty — a vacuum disguised as reassurance.

4. Why Transport? The logic of bureaucratic containment

Transport is a safe portfolio. It is:

• administratively neutral

• politically low‑risk

• unlikely to produce a reply that creates wider scrutiny

• disconnected from the systemic issues I raised

This makes it an ideal “containment portfolio” — a place where politically sensitive correspondence can be parked without consequence.

It is the bureaucratic equivalent of placing a burning fuse into a bucket of sand.

5. The wider pattern: avoidance, deflection, and procedural insulation

This reply fits the same pattern I’ve seen across multiple OIA processes:

• MFAT deflecting on Ukraine alignment

• Health avoiding toxin‑testing accountability

• Environment sidestepping 1080 operational transparency

• Police refusing to explain drug‑wipe testing ethics

• Ombudsman delays stretching into months or years

Each case reveals a system that is structurally resistant to scrutiny. Luxon’s office did respond — and that matters — but the type of response is part of the pattern.

It acknowledges the email without engaging with it.

It responds without responding.

This Open Letter is issued because the Ombudsman process has proven unable to address the systemic issues uncovered through my Official Information Act (OIA) investigations. The Ombudsman cannot investigate Ministers, cannot correct Cabinet‑level procedural failures, and cannot resolve contradictions between agencies.

Therefore, I am bypassing the Ombudsman and addressing this matter directly to the Prime Minister, the New Zealand Police, and the public.

This letter concerns the Roadside Oral‑Fluid Drug Testing regime, introduced through the Land Transport (Drug Driving) Amendment Bill, and the absence of any verified chemical safety assessment by the agency that Cabinet relied upon: WorkSafe New Zealand.

1. What Police Have Stated (Verifiable Quotes)

Across multiple OIA responses, the New Zealand Police have made clear safety and regulatory claims about the DrugWipe oral‑fluid testing device. These include:

Through OIA responses received on 21 July 2026, WorkSafe confirmed:

“WorkSafe has not identified any documents in scope of your request.”

This single sentence was the full extent of WorkSafe’s involvement in the legislative process.

3. The Contradiction

Police have made multiple safety and compliance claims about the DrugWipe device.
Police have stated that WorkSafe was consulted.
Police have stated that WorkSafe assessed hazardous substances at Police workplaces.

However:

• WorkSafe did not assess chemical safety

• WorkSafe did not review SDS

• WorkSafe did not review chemical composition

• WorkSafe did not verify “20 years of safe use”

• WorkSafe did not verify workplace exposure safety

• WorkSafe did not verify compliance

• WorkSafe did not provide any safety assurance to Cabinet

WorkSafe’s consultation consisted of a single line:

“WorkSafe has no substantial feedback.”

This is not a safety assessment.
It is not a regulatory review.
It is not an expert opinion.
It is not verification.
It is not oversight.

Yet Cabinet proceeded with the Bill as though WorkSafe had provided meaningful safety input.

4. The Legislative Failure

The Roadside Drug Testing regime was approved by Parliament under the belief that WorkSafe had been consulted as the workplace safety regulator.

WorkSafe was indeed “consulted” — but only in the procedural sense.
Their actual contribution was:

“WorkSafe has no substantial feedback.”

No chemical safety review was performed.
No SDS was reviewed.
No hazard classification was verified.
No toxicology assessment was conducted.
No workplace exposure analysis was undertaken.

This constitutes a Cabinet‑level procedural failure.

The public, Police, and Parliament were left with the impression that WorkSafe had provided safety assurance.
WorkSafe’s own documents show that no such assurance exists.

5. Why This Matters

The DrugWipe device contains:

• reagents

• solvents

• preservatives

• chemical indicators

These are hazardous substances under HSWA unless proven otherwise.

Police frontline staff handle these devices daily.
The public is tested with them roadside.
The devices are used in uncontrolled environments.

Yet the regulator responsible for workplace chemical safety:

• did not assess the device

• did not review its chemical hazards

• did not verify its safety

• did not provide any advice to Cabinet

• did not confirm compliance

• did not review SDS

• did not review toxicology

This is not a minor oversight.
It is a systemic failure.

6. Request to the Prime Minister

I respectfully request that the Prime Minister initiate:

1. A Cabinet‑level review of the safety basis for the DrugWipe device.

2. A clarification of WorkSafe’s role in the legislative process.

3. A correction of public messaging where Police safety claims are unsupported.

4. A verification of whether the device meets HSWA and Hazardous Substances Regulations requirements.

5. A reassessment of chemical safety obligations for frontline Police staff.

This request is made in good faith, based on verified documents, and in the public interest.

7. Closing Statement

This Open Letter is issued because the Ombudsman cannot address contradictions between agencies or procedural failures at Cabinet level.
The evidence obtained through OIA shows a clear discrepancy between Police safety claims and WorkSafe’s documented non‑involvement in chemical safety assessment.

When I first wrote to the Prime Minister about the systemic delays and structural failures inside the Office of the Ombudsman, I did not expect a particularly meaningful response. Historically, concerns about Ombudsman timeliness are treated as individual grievances, not constitutional issues. What I received today, however, was something quite different — and far more significant.

This article documents exactly what the Prime Minister’s office sent me, what it means in constitutional terms, and the formal action I have now taken in response.

1. The Prime Minister’s Office Responds

Today I received a formal reply from Christopher Luxon’s office. It was not a generic acknowledgement, nor a deflection back to the Ombudsman. Instead, it contained three major actions — each of which carries constitutional weight.

The correspondence stated that my concerns have been:

• Forwarded to the Office of the Ombudsman

• Forwarded to the coalition leaders and the Speaker of the House

• Provided to the Officers of Parliament Committee (OPC) for its consideration

The message also noted that the OPC has oversight responsibilities relating to the Ombudsman’s funding and resourcing, and that I should expect to hear back from them regarding any further consideration of the matters I raised.

Finally, the Prime Minister’s office advised that I may wish to submit a petition to the House of Representatives requesting that a select committee inquire into the Ombudsman’s capacity, timeliness, or funding adequacy.

This is not a routine response. It is a procedural opening.

2. Why This Matters

To understand the significance, it’s important to recognise the constitutional architecture around Officers of Parliament.

The Ombudsman is not a government department. It is an independent Officer of Parliament, accountable through:

• The Speaker

• The Officers of Parliament Committee

• Parliament itself

For the Prime Minister’s office to escalate my concerns to all three of these actors — and to explicitly recommend a petition — is a clear signal that the issues I raised are not being treated as personal complaints. They are being treated as systemic concerns about the functioning of an institution that underpins the Official Information Act.

This is precisely the framing required for Parliament to take notice.

3. A Notable Contradiction

Earlier, I was told by parliamentary staff that the Officers of Parliament Committee “does not oversee performance.” Luxon’s office has now stated the opposite: that the OPC does have oversight responsibilities relating to the Ombudsman, including matters of funding and resourcing.

This contradiction is important. It shows that the Prime Minister’s office views the issue through a political‑constitutional lens rather than a narrow procedural one. And political interpretations are what matter when committees decide whether to act.

4. What I Have Done

Acting on the advice from the Prime Minister’s office, I have now taken the next formal step.

I have submitted a petition to the House of Representatives.

The petition requests that Parliament refer to the relevant select committee an inquiry into:

• The timeliness of Ombudsman investigations

• The capacity of the Office of the Ombudsman

• The adequacy of its resourcing and funding

• The impact of delays on the Official Information Act’s purpose

• Any structural improvements required to ensure the Ombudsman can fulfil its constitutional role

The petition was submitted with a formal cover letter (contained in the email body), and the petition itself was attached as a clean PDF — the standard format for constitutional submissions.

This creates a permanent record and places the issue formally before Parliament.

5. What Happens Next

The Clerk will process the petition and route it appropriately. The relevant select committee will then decide whether to open an inquiry. Given that:

• The Prime Minister’s office has already escalated the matter

• The Speaker and coalition leaders have been notified

• The Officers of Parliament Committee has been engaged

…the petition now sits within the full accountability chain for the Ombudsman.

This is the correct constitutional pathway for addressing systemic delays that undermine the Official Information Act.

6. Why I’m Publishing This

Transparency matters. The OIA exists to ensure accountability, and the Ombudsman exists to ensure the OIA works. When delays stretch into years, the system fails.

Publishing this process serves two purposes:

1. To document the steps taken

2. To demonstrate that individuals can, in fact, trigger parliamentary scrutiny when the system is not functioning as intended

This is not about personal frustration. It is about the integrity of a core democratic mechanism.

“We consider the matter would be best handled by the clinical management sector.”

This single sentence demonstrates a troubling pattern: when confronted with a systemic gap affecting millions of New Zealanders on long‑term medication, the Committee’s instinct was not to investigate, not to request evidence, not to seek clarification — but simply to pass responsibility elsewhere.

This is not oversight.
It is abdication.

A Committee Representing Every Major Party — Yet No One Acted

The Health Committee is composed of members from National, Labour, ACT, the Greens, NZ First, and Te Pāti Māori.

In other words, every major political force in New Zealand sits at your table.

And yet, faced with a clear national‑level health failure — the complete absence of any policy, guideline, protocol, framework, or clinical standard for medication‑induced nutrient depletion — not one of you could kick the ball over the post.

Not one of you asked for evidence.
Not one of you requested a briefing.
Not one of you sought expert input.
Not one of you initiated even a preliminary review.

Frankly, it is shameful.

This is not a partisan failure.
It is a collective failure of Parliament.

A Health System Already Under International Scrutiny

New Zealand’s health system is already known internationally for:

• human‑rights breaches in disability care

• failures in mental‑health access

• unsafe wait‑times

• inconsistent pharmacovigilance

• repeated Ombudsman findings of systemic neglect

The absence of any national‑level standard for medication‑induced nutrient depletion — a well‑documented risk in global clinical literature — is yet another example of a system that reacts only after harm occurs.

Your Committee had the opportunity to lead.
Instead, you passed the responsibility to an operational department that has no mandate to create national policy.

This is not teamwork.
This is political buck‑passing.

A Call to All Party Leaders

Because this issue affects every New Zealander who takes long‑term medication, I am copying this letter to:

New Zealand’s proposed sexual‑consent changes mirror the UN’s OHCHR guidance almost word‑for‑word. The framing, the terminology, the “affirmative consent” model — all of it lines up with UN documents and Agenda 2030’s gender‑violence targets.

Yet the public narrative is:

“New Zealand needs to modernise its consent laws.”

No mention of:

• UN frameworks

• Agenda 2030

• SDG reporting

• international alignment

• global human‑rights directives

It’s presented as a domestic initiative.
But the fingerprints are international.

This is not speculation.
This is pattern recognition.

We’ve Seen This Pattern Before: The Plastic‑Bag Ban

Jacinda Ardern famously claimed she banned plastic bags because she received “letters from children.”

It was a charming story.
It was also political theatre.

The ban aligned perfectly with:

• UN Environment Programme campaigns

• UNEP’s “Beat Plastic Pollution” initiative

• OECD directives

• global plastics‑treaty negotiations

New Zealand’s ban was announced in sync with these international pushes.

The “children’s letters” narrative was a PR wrapper.
The real driver was UN‑aligned environmental policy.

This matters because it shows the mechanism:

External agenda → domestic narrative → bipartisan adoption.

And we’re watching the same mechanism unfold again.

Jacinda Ardern’s Admission at the Gates Foundation

At the Bill & Melinda Gates Foundation’s Goalkeepers event, Jacinda Ardern openly stated that New Zealand was implementing Agenda 2030 into domestic policy.

Not “influenced by.”
Not “aligned with.”
Not “considering.”

Implementing.

Agenda 2030 is a UN framework.
Jacinda committed NZ to embedding it.

Under the ordinary definition of control — the one we all use in daily life — this is control.

Luxon Has Said the Same — Continuity Across Elections

Christopher Luxon has also publicly committed New Zealand to Agenda 2030 alignment.

Different party.
Same commitment.
Same framework.
Same continuity.

When two competing parties implement the same external agenda across elections, the source of direction is outside the party system.

This is not “Labour policy.”
This is not “National policy.”

This is UN‑aligned policy implemented through both parties.

Under the ordinary definition, this is control.

The Strange Silence: Why Sexual Consent, But Not Medical Consent?

Here’s the part that should make everyone pause.

The UN’s consent frameworks include:

• sexual consent

• medical informed consent

• bodily autonomy

• capacity standards

• rights‑based decision‑making

But New Zealand politicians:

• aggressively push sexual‑consent reform

• adopt UN‑aligned language

• cite international norms

…and never mention:

• medical informed consent

• patient autonomy

• capacity requirements

• comprehension standards

Why?

Because medical informed consent would:

• expose contradictions in NZ’s health‑rights system

• threaten institutional power

• complicate roadside drug‑testing consent

• raise uncomfortable questions about coercion in healthcare

Sexual consent is politically safe.
Medical consent is politically dangerous.

So NZ adopts one UN norm and ignores the other.

This selective adoption is the giveaway.

Roadside Drug Testing: The Consent Question No One Wants to Touch

If NZ is rewriting sexual‑consent law to require:

• active agreement

• clear communication

• voluntary participation

…then what does that mean for roadside drug testing?

Is a driver:

• free to decline?

• coerced by threat of penalty?

• capable of informed consent?

• aware of the consequences?

• able to withdraw consent?

If sexual consent requires affirmative agreement,
why does roadside drug testing rely on compelled compliance?

Why is bodily autonomy protected in one domain but not another?

Why is UN‑aligned sexual consent adopted,
but UN‑aligned medical consent ignored?

This inconsistency is not accidental.
It is political.

Conclusion: When Both Parties Move Together, Look Upstream

New Zealand’s sexual‑consent reform:

• originates from UN frameworks

• is adopted by both major parties

• follows the Agenda 2030 trajectory

• mirrors the plastic‑bag precedent

• continues the bipartisan alignment Jacinda and Luxon both admitted

• and selectively ignores medical informed consent for political convenience

Under the ordinary definition of control — the one we all use — this is control.

Not legal control.
Not coercive control.
But authoritative influence that directs outcomes, implemented through both parties.

New Zealanders deserve to know where their laws come from.
And they deserve to ask why some forms of consent matter — and others mysteriously do not.

3. Secondary poisoning risk
   Please provide any scientific assessments, internal briefings, or external advice held by the Ministry regarding the likelihood of secondary poisoning of seabirds via ingestion of contaminated invertebrates, carrion, or other trophic pathways following 1080 operations.

4. Recent 1080 operations
   Please provide a list of all 1080 aerial or ground‑based operations conducted in New Zealand in the past six months, including dates and locations, and identify which of these sites fall within the typical flight range of a brown skua (including drift‑assisted ranges).
   If such flight‑range assessments have been conducted internally, please provide them.

Why These Questions Matter

When a brown skua washed up in Petone and was quickly described as “detected with H5N1,” the public was given a single, simple story: a virus arrived, a bird died, and that was that. But real biosecurity work is never that simple. It depends on ruling out all plausible causes — not just the one that fits the headline.

That’s why these questions matter.

If a bird is found dead, the first step in any robust investigation is to check for other lethal agents, including toxins. If that wasn’t done, we need to understand why. If skua diets include invertebrates, and if those invertebrates can carry secondary 1080 residues, then ignoring that pathway leaves a blind spot in our national risk assessment. And if recent 1080 operations occurred within the flight range of the species, that’s relevant context — not speculation.

None of this challenges the possibility of H5N1. It simply asks whether the investigation was complete.

New Zealand’s biosecurity system is strongest when it is transparent, methodical, and willing to examine every reasonable vector. These OIA questions are designed to clarify whether that happened here — and whether any steps were skipped in the rush to attribute a cause.

New Zealand is undergoing a political transformation that most people haven’t noticed — not because it’s hidden, but because it’s happening through policies that appear protective, modern, or “common sense.” Yet when you line these policies up, a pattern emerges: the state is steadily expanding its power to regulate behaviour, while shrinking the space for personal autonomy, moral reasoning, and civic responsibility.

This isn’t a partisan critique. It’s a structural one.

And it’s happening across sexual‑consent law, policing powers, vehicle seizure legislation, prison expansion, and even the health sector’s approach to informed consent. Each domain tells the same story: the government is shifting from governing harm to governing behaviour.

1. The New Sexual‑Consent Law: Empowerment or Expansion of State Power?

National’s proposed reform to sexual‑consent law — redefining consent as an active “yes” — is framed as modernisation. It’s presented as empowerment, clarity, and protection.

But structurally, it does something else.

• It expands criminal liability into more subjective territory.

• It shifts adjudication power toward the state, not the individuals involved.

• It makes proving innocence harder, because the absence of a “yes” becomes prosecutable even when both parties believed consent existed.

This is not about whether the reform is “good” or “bad.”
It’s about recognising what it does: it moves sexual behaviour further into the realm of state‑defined compliance rather than interpersonal negotiation or social norms.

Consent becomes less about human communication and more about legal compliance.

2. Car‑Crushing for “Intimidating” Driving: Criminalising Vibes

The recent proposal allowing police to crush a vehicle if the driving was deemed “intimidating” is another example of behavioural governance.

Not dangerous.
Not harmful.
Not illegal racing.
Just intimidating — a psychological interpretation.

This is a profound shift:

• Punishment without clear harm

• Discretion without objective thresholds

• Criminalisation of perceived behaviour rather than actual conduct

It’s the state saying: We will decide what your behaviour means, and we will punish you based on that meaning.

This is not liberal democracy.
This is behavioural conditioning.

3. Building More Prisons: The Anticipation of Manufactured Criminals

Governments don’t build prisons because they hope crime will rise.
They build prisons because they expect their legislative agenda will create more offenders.

When you criminalise more behaviours — especially subjective ones — you must expand incarceration capacity.

The prison‑building programme is not a response to crime statistics.
It is a response to policy design.

The state is preparing for the consequences of its own legislative expansion.

4. The Moral Vacuum: Police Without Ethics, Health Without Consent

Two admissions should alarm anyone who cares about civic integrity:

• NZ Police have stated they operate without moral principles — they operate strictly on law, not ethics.

• NZ Health has no enforceable informed‑consent regulation — only a complaints mechanism that can be dismissed as “unreasonable.”

These are not small details.
They are foundational.

A state without moral principles + expanding coercive legislation = a system that governs by force, not ethics.

A health system without enforceable consent + expanding behavioural criminalisation = a population increasingly governed by compliance rather than autonomy.

This is not conspiracy.
This is governance philosophy.

5. The Pattern: Behavioural Governance

When you connect the dots, the picture becomes clear:

• Sexual behaviour is being legislated through affirmative‑consent mandates.

• Driving behaviour is being criminalised through subjective police interpretation.

• Prison infrastructure is expanding to accommodate the predictable increase in “offenders.”

• Health and policing systems operate without moral frameworks, relying solely on compliance.

This is the architecture of behavioural governance — a model where the state shapes citizens through coercive law rather than education, ethics, or civic development.

It is governance through fear of punishment rather than cultivation of responsibility.

6. Why These Laws Feel Empowering — But Aren’t

Many of these policies are framed as:

• protecting victims

• modernising norms

• improving safety

• reducing harm

• empowering vulnerable groups

But the structural effect is:

More state power, less citizen autonomy.

This is the paradox of modern legislation:
It uses the language of empowerment to justify expansion of coercive authority.

7. The Real Danger: Loss of Civic Agency

When the state governs behaviour instead of harm, citizens lose:

• the ability to negotiate social norms

• the responsibility to develop moral reasoning

• the autonomy to make decisions without fear of criminalisation

• the expectation that law is a last resort, not a first tool

A society governed by behavioural legislation becomes a society of subjects, not citizens.

8. The Question New Zealand Must Confront

New Zealand must decide whether it wants:

• a government that protects rights and minimises harm
  or

• a government that shapes behaviour through coercive law

Because right now, without public debate, without philosophical grounding, and without moral oversight, we are drifting — quietly, steadily — into the second model.

And once behavioural governance becomes normal, reversing it becomes almost impossible.

🧭 9. The Missing Piece: Why Is There No Investment in Moral Education?

f the government is genuinely concerned about sexual harm, dangerous driving, social disorder, or civic breakdown, there is an obvious question:

Where is the investment in teaching moral values, integrity, responsibility, and reason?

Because if the goal were truly to reduce harm, the most effective tools would be:

• ethical education in schools

• public campaigns on respect, consent, and responsibility

• programmes that teach emotional intelligence and conflict resolution

• community‑based moral development

• civic education that explains rights, duties, and justice

None of these exist in any meaningful form.

Instead, the government consistently chooses:

• more laws

• more police powers

• more criminal categories

• more prisons

• more punitive mechanisms

This is not a strategy for reducing harm.
It is a strategy for increasing control.

Why moral education is absent

There are three structural reasons:

1. Moral education empowers citizens.
   Empowered citizens question authority, resist overreach, and demand accountability.
   Behavioural governance requires compliance, not autonomy.

2. Moral reasoning reduces dependence on the state.
   If people can resolve conflicts, negotiate consent, and behave responsibly, the state loses its justification for expanding coercive power.

3. Ethics cannot be centrally controlled.
   Moral principles are universal, philosophical, and often inconvenient for governments.
   They limit power.
   They constrain legislation.
   They expose contradictions — like the Police admitting they have no moral principles.

The result

New Zealand ends up with:

• law without ethics

• compliance without understanding

• punishment without education

• citizens who are regulated, not developed

This is the hallmark of behavioural governance:
The state shapes behaviour through coercion because it refuses to cultivate the moral capacity that would make coercion unnecessary.

There is a moment in every investigation where the dots all connect and the picture becomes clear.
For me, that moment came when I graphed the revenue histories of five psychiatric drugs — Geodon, Effexor, Pristiq, Chantix, and Zoloft — and placed them alongside the regulatory actions that eventually landed on each one.

The pattern was unmistakable.
And it was not biological.
It was financial.

1. The profit curve always peaks before the truth arrives

Every drug followed the same choreography:

• Revenue climbs.

• Revenue peaks.

• Revenue stabilizes.

• Only then do regulators intervene.

Black Box warnings arrive after peak sales.
Fines arrive after the market is saturated.
Liability arrives after the profit has already been extracted.

By the time the Department of Justice shows up with a settlement, the drug has already:

• captured the market

• generated billions

• begun its decline

• moved into generic erosion

The fine becomes a post‑profit administrative event, not a deterrent.

It is a cost of doing business.

2. The warnings arrive too late to matter

The FDA’s Black Box warnings — suicidality, neuropsychiatric effects, pediatric risks — appear only after the drug is deeply embedded in clinical practice.

By then:

• prescribers are habituated

• patients are stabilized

• marketing has done its work

• revenue has already been realized

A warning at that stage does not meaningfully change the curve.
It simply marks the point where regulators finally caught up.

3. The fines arrive even later

The fines — some of them enormous — land years after the peak revenue.

They do not reduce profit.
They do not change corporate behavior.
They do not alter the business model.

They are absorbed.
They are budgeted.
They are expected.

They are a fine problem to have in profits.

4. The pivot: when the liability became intolerable

By the late 2000s, psychiatric drugs had become:

• heavily scrutinized

• heavily litigated

• heavily regulated

• increasingly risky

Pfizer’s boardroom did not need a conspiracy.
They needed a new profit model.

And they found one.

Vaccines.

Vaccines offered everything psychiatric drugs did not:

• guaranteed demand

• government purchasing

• government indemnification

• no direct‑to‑consumer liability

• no Black Box warnings

• no chronic‑use safety profile

• no long‑term litigation exposure

• no generic erosion

From a purely financial perspective, vaccines are:

the perfect pharmaceutical product.

And the legal mechanism that made them perfect was Clause 5.5.

⭐ Clause 5.5 — The Indemnification Engine

“Pfizer shall not be liable for any claims, damages, or losses arising from or relating to the vaccine.”

The rest of Clause 5.5, summarized:

• The government assumes full legal responsibility.

• Pfizer is shielded from civil claims.

• Pfizer is shielded from administrative claims.

• Pfizer is shielded from regulatory claims.

• Pfizer is shielded from manufacturing‑related claims.

• Pfizer is shielded from distribution‑related claims.

• Pfizer is shielded from adverse‑event claims.

• Pfizer is shielded from negligence claims.

• Pfizer is shielded from product‑defect claims.

• Pfizer is shielded from failure‑to‑warn claims.

• Pfizer is shielded from any future claims arising from new evidence.

In short:

Clause 5.5 eliminates the “fine problem” entirely.

The liability that haunted the psychiatric drug portfolio disappears.

5. The timing aligns with strategy, not discovery

Pfizer’s vaccine expansion aligns with:

• rising psychiatric drug scrutiny

• plateauing psychiatric drug revenue

• increasing litigation exposure

• increasing regulatory burden

• the emergence of indemnified vaccine markets

This does not prove intent.
But it does prove incentive.

The pivot makes sense when you look at the curves.

6. What the graph actually reveals

The graph does not tell us what Pfizer “believes.”
It does not tell us what Pfizer “cares about.”
It does not tell us what Pfizer “intended.”

But it does tell us what Pfizer responded to.

It shows:

• a business model that produced vast profits

• a regulatory system that reacted too slowly

• a fine structure that arrived too late

• a warning system that arrived too late

• a pivot into a market where none of those problems exist

The vaccine industry did not emerge from nowhere.
It emerged from a set of incentives that made it the ideal successor to a business model that had become increasingly constrained.

This is not a conspiracy.
It is a profit‑curve‑driven strategic pivot.

And once you see it, you cannot unsee it.

7. The conclusion you can safely draw

You cannot say Pfizer “created vaccines to avoid fines.”
You cannot say Pfizer “does not care about health.”

But you can say:

The financial incentives created by late warnings, late fines, and indemnification made vaccines a strategically superior profit model compared to psychiatric drugs.

That conclusion is supported by the data.
It is visible in the curves.
It is visible in the timing.
It is visible in the pivot.

And it is visible in Clause 5.5.

The correspondence below is published as part of an ongoing record of my interactions with the Office of the Ombudsman. It illustrates a pattern I have repeatedly encountered: senior staff responding to legitimate process concerns with personalised commentary, defensiveness, and argumentative framing rather than addressing the substance of the issues raised. This tone is inconsistent with the neutrality expected of an oversight body and raises questions about the office’s ability to engage impartially with complainants who scrutinise its conduct.

I really do not wish to argue the matter further, and I will not be replying to this letter. My view is simply that the tone and approach displayed here are surprising and not reflective of the standards expected of the Ombudsman’s role. Publishing this material is for transparency — to allow the public to see the nature of the communication directly and form their own view of whether it meets those standards.

We won’t be commenting on your criticisms of our office, other than to say they are misplaced.

Our letter gives you the opportunity by 28 July to comment on the various courses of action we have set out on those individual complaints. You still have that opportunity to comment and we would welcome your engagement with the actual substance of our letter.

You say ‘Unless the Ombudsman provides a public acknowledgement that the personal commentary contained in the 14 July letter was inappropriate, and unless the office confirms that future investigations will be conducted on the basis of the concerns raised — not on any perceived judgement of my character — I will consider the 14 July letter to be a formal breach of Ombudsman neutrality and will proceed accordingly.’ We will not be doing this. This image was one I shared on facebook this evening. It was getting views, getting shared…..suddenly it disappeared…..I cannot find it. The comments coming in of people who had seen it suddenly stopped coming in. I did not even have the summary below with it. I just had “Mainstream Media have it covered” as a title.

A brown skua — a long‑range scavenging seabird known for travelling thousands of kilometres across the Southern Ocean — was found dead on Petone Beach, roughly 12 km from Victoria University of Wellington.

Laboratory testing confirmed the bird carried H5N1 avian influenza.

Victoria University of Wellington has recently been involved in influenza A surveillance research, including detection of H1‑lineage influenza viruses in New Zealand wildlife. This means the first confirmed case of H5N1 in New Zealand occurred within close proximity to a university conducting research on the same family of influenza viruses.

In short, a scavenger bird just happened to arrive within about 12km of a University that just happened to be researching the precise disease this bird died from! You call that unfortunate coincidence? I call it planted evidence.

Two decisions arrived from the Ombudsman this week — both finalised on the same day, both signed personally by the Chief Ombudsman, both dismissing my rebuttals without addressing a single argument I raised. And both relied on the same device:

“I am not persuaded to change my view.”

Not statutory analysis.
Not legal reasoning.
Not the tests required under the Official Information Act.
Just opinion.

This would be concerning in any context.
But the OIA requests I have been making are not abstract policy questions or casual curiosities. They concern critical gaps in New Zealand’s legislative and regulatory framework — gaps that have already cost lives, and will cost more if left unaddressed.

The shipping emissions case — where lives have already been lost

For months I have been asking the Ministry for the Environment — now absorbed into the Ministry for Cities, Environment, Regions and Transport — about the role of shipping emissions in flood intensification. This is not theoretical. People have already died in events where aerosol‑driven cloud formation and rainfall amplification are plausible contributing factors.

Yet the Ministry has stated, in writing, that it:

• has not investigated the issue,

• does not monitor shipping emissions,

• holds no evidence on the matter,

• and has no intention of investigating it.

Despite this, they confidently assert there is “no evidence” of any link.

You cannot claim “no evidence” when you have never collected any evidence.

This is not a minor oversight. It is a structural failure in environmental governance — one with direct human consequences.

The nutritional supplementation case — another life‑and‑death gap

My other OIA request concerns the absence of any requirement for clinicians to monitor nutritional depletion in people who are:

• on long‑term medication, or

• withdrawing from medication.

This is not a fringe issue. Many common medications deplete essential nutrients. Those deficiencies can destabilise withdrawal, increase pain sensitivity, impair cognition, and in some cases become life‑threatening.

Yet Health New Zealand has confirmed:

• no national protocol exists,

• no safeguard exists,

• no monitoring requirement exists,

• no funded pathway exists,

• and no regulatory obligation exists to warn patients.

Again: this is not a theoretical gap. It is a clinical risk that has already harmed people and will continue to do so.

These are not matters one can casually discard based on personal opinion.

And yet — the Ombudsman’s response is opinion, not law

In both decisions, the Ombudsman relied on subjective phrasing:

• “I am satisfied…”

• “I am not persuaded…”

• “In my opinion…”

Instead of demonstrating how the statutory tests were applied.

In one case, he even endorsed a Ministry’s threat to use section 18(h) — the “frivolous or vexatious” refusal — if I continued to ask questions. That is the nuclear option of the OIA. It is supposed to be used sparingly, with clear justification. Instead, it was waved at me like a behavioural warning.

When oversight becomes opinion, accountability becomes optional.

And when accountability becomes optional, people get hurt.

So I have taken the next step

Today I lodged a new OIA request with the Ombudsman’s Office. It asks for all internal documents, policies, training materials, legal interpretations, and memos that justify or explain the use of “opinion” as the basis for determining OIA outcomes.

If “opinion‑based adjudication” is a formal methodology, the public deserves to see the framework.

If it isn’t, then the public deserves to know that decisions are being made without one.

This isn’t about winning a particular case.
It’s about ensuring that the OIA — one of the few tools ordinary people have to understand what their government is doing — doesn’t quietly become discretionary.

I’ll publish whatever they send me.
If documents exist, we’ll see the framework.
If they don’t, we’ll see the gap.

Either way, sunlight is coming.

Introduction

This letter responds to the Ombudsman’s 12‑page communication dated 14 July 2026.
My purpose is not to revisit the substance of the OIA complaints themselves, but to address the conduct, tone, and procedural approach demonstrated in the Ombudsman’s response.

The Ombudsman holds a constitutional role in safeguarding transparency, accountability, and public trust.
For that reason, the standards of neutrality, professionalism, and procedural fairness expected of the office are exceptionally high.

The letter I received raises serious concerns about whether those standards have been met.

1. A 12‑page response produced only after public criticism

Across all complaints listed, the Ombudsman’s office did not provide:

• updates

• notifications

• progress reports

• preliminary views

• requests for clarification

Not once.

Yet immediately following my open letter of 13 July, the Ombudsman produced:

• a consolidated multi‑agency review

• multiple preliminary opinions

• multiple “we have provided advice” statements

• multiple “we are prepared to investigate” statements

• multiple “we are likely to refuse” statements

All at once.

This sudden burst of activity — after months of silence — strongly suggests that the work was undertaken only because the office’s reputation was challenged publicly, not because of any internal commitment to timely or transparent complaint handling.

This reactive posture is inconsistent with the Ombudsman’s duty to act independently of public pressure or personal criticism.

2. Inappropriate personal commentary and repeated judgement of the complainant

The Ombudsman’s letter contains multiple statements that directly judge my character, intentions, and behaviour. These include assertions that I:

• act in bad faith

• impose excessive burden on public resources

• misuse generative AI

• hold “fixed positions”

• engage in “simple debate”

• lack legitimate purpose

• threaten staff safety through satire

• undermine the Ombudsman’s office

• am insincere in my engagement

These statements are not only inappropriate — they are contrary to the Ombudsman’s own standards of conduct, which prohibit personal judgement of complainants.

The Ombudsman’s role is to assess agency conduct, not citizen character.

The repeated personal commentary throughout the letter represents a significant departure from expected neutrality.

3. Attempted suppression of transparency

The Ombudsman wrote:

“Sharing this letter on online forums may be taken as a sign you are not engaging with us in good faith.”

This is an extraordinary statement.

The Ombudsman is a public office.
Its communications are subject to public scrutiny.
Transparency is not a threat — it is a democratic safeguard.

Any suggestion that publishing an Ombudsman letter is improper or indicative of bad faith is inconsistent with the principles of open government and public accountability.

4. Inappropriate scientific conclusions outside the Ombudsman’s mandate

One of the most concerning statements in the letter is:

“On reviewing the correspondence between yourself and ESNZ, it is difficult to see how there could be any merit to these process-based concerns.”

This is not a procedural assessment.
It is a scientific judgement.

The Ombudsman is not an atmospheric science authority.
It cannot determine whether concerns about:

• aerosol modelling

• sulphur emissions

• cloud microphysics

• rainfall intensification

• flood‑risk modelling

The Ombudsman’s dismissal of concerns that directly relate to public safety and environmental modelling is inappropriate, outside its mandate, and inconsistent with the evidence provided.

5. Failure to address contradictions within agency responses

Across multiple agencies — including ESNZ, NZTA, Te Whatu Ora, MPI, and the Police — there are clear contradictions between:

• internal emails

• public statements

• OIA responses

• scientific relevance

• operational practice

The Ombudsman’s letter does not address these contradictions.
Instead, it focuses on criticising the complainant.

This represents a failure to uphold the Ombudsman’s core function:
to evaluate agency conduct, not to defend it.

6. A pattern of institutional defensiveness

Taken together, the tone and content of the Ombudsman’s letter demonstrate:

• defensiveness

• personalisation

• minimisation of legitimate concerns

• reluctance to scrutinise agencies

• willingness to scrutinise the complainant instead

• attempts to discourage public transparency

• attempts to reframe substantive issues as frivolous

• attempts to delegitimise the complainant’s methodology

This pattern is inconsistent with the Ombudsman’s constitutional role.

7. An opportunity for the Ombudsman to reset its approach

I wish to make one final point clear.
My concerns have always been about the governance of New Zealand, not about myself. The issues I have raised relate to public safety, environmental modelling, transparency, and the lawful administration of the Official Information Act. These matters affect every New Zealander.

For that reason, I am prepared to give the Ombudsman’s office an opportunity to reset its approach.

Unless the Ombudsman provides a public acknowledgement that the personal commentary contained in the 14 July letter was inappropriate, and unless the office confirms that future investigations will be conducted on the basis of the concerns raised — not on any perceived judgement of my character — I will consider the 14 July letter to be a formal breach of Ombudsman neutrality and will proceed accordingly.

This is not a threat.
It is an invitation to restore professionalism, impartiality, and public confidence in the Ombudsman’s role.

Conclusion

This second open letter is not written in anger.
It is written in concern.

The Ombudsman’s 12‑page response contains:

• inappropriate personal commentary

• scientific conclusions outside its mandate

• attempts to discourage transparency

• dismissive language inconsistent with neutrality

• reactive behaviour inconsistent with independence

These issues must be acknowledged and addressed.

New Zealand relies on the Ombudsman to uphold the integrity of the OIA system.

It looks like law, but it functions like a complaints brochure.

And nowhere is this failure more dangerous than in the area of medication‑induced nutrient depletion and withdrawal‑related biochemical collapse.

⚠️ Black Box warnings expose the system’s fatal contradiction

Many commonly prescribed medications carry Black Box warnings — the strongest safety warnings used internationally.

These warnings explicitly state:

• may cause aggressive thoughts or actions

• may cause suicidal thoughts

• may cause suicidal thoughts during cessation

These are not mild side effects.
They are catastrophic behavioural risks.

And here is the part the public never hears:

These behavioural risks are strongly linked to nutrient depletion, metabolic disruption, and withdrawal‑related biochemical instability.

In other words:

**Black Box warnings are biochemical warnings.

They require biochemical support.
But New Zealand provides none.**

There is no national nutritional protocol for medicated or withdrawing patients.
There is no requirement to warn patients about nutrient depletion.
There is no requirement to monitor biochemical deterioration.
There is no requirement to provide nutritional rehabilitation.

The system acknowledges the behavioural danger
but ignores the biochemical cause.

🧩 Why the system cannot fix itself: The HDC Code is not regulation

The Health and Disability Commissioner’s Code is often described as “the regulation that protects informed consent.”

But this is false.

The Code is secondary legislation, meaning:

• It cannot compel Health NZ or Medsafe to act

• It cannot mandate protocols

• It cannot impose standards

• It cannot force systemic change

Its only tool is complaints.

And complaints can be dismissed as:

• frivolous

Meaning:

There is no actual requirement for anyone to do anything.

The public thinks informed consent is protected by law.
It isn’t.

It is protected by a Code that can be ignored.

🧨 The nutritional‑protocol failure proves the system is hollow

Because Medsafe has never classified nutrient depletion as a material risk, clinicians are not required to disclose it.

Therefore:

• informed consent is technically “complete”

• no breach exists

• the HDC cannot enforce anything

New Zealand has built a system where:
